These Terms and Conditions (the "Terms") are legally binding. We, Rufio App S.L., a company incorporated and registered in Spain with company number 25072758 at Calle de la Palma 4, 2D, 28004, Madrid, Spain ("Rufio", "we" or "us") give you the right to access and use the Rufio mobile application (the "App"), and the resources and services made available to you via the App subject to the Terms. Please ensure that you read these Terms carefully before using our App and creating your account.
1.1 These Terms govern the access, browsing and use of the App by users ("Users", "you / your").
1.2 Acceptance of Terms. By using our App and creating your user account, you confirm your acceptance of these Terms and our associated Policies (as set out below) and that you agree to comply with these Terms and Policies. If you do not agree with these Terms, you should not use the App in any way.

1.3 Apple and Google Play Store's Terms also apply. 1.4 The App is made available and provided to Users in the United Kingdom only. Whilst access from outside of the United Kingdom may be possible, the App is not intended for such use, and any such access or use is done so at your own risk.
1.5 Amendment of Terms. We may make changes to these Terms and our Policies from time to time, in which case all updates will be made available via the App. You should regularly review these Terms and Policies to ensure you are happy with any changes. You will be deemed to have accepted any changes to the Terms and Policies if you continue to access or use the App, where the updated Terms and Policies will be available for you to view.
2.1 In order to use the App, you must register and create a personal user account ("Rufio Account").
2.2 You will be required to create a unique username and password when registering your Rufio Account. You must keep your username and password confidential and not disclose this information to anyone else.
2.3 By creating a Rufio Account, you undertake:
(a) not to provide any false information, or create an account on behalf of anyone else without their prior authorisation;
(b) not to create more than one Rufio Account;
(c) to keep your contact details and personal information up to date;
(d) not to take any action which would compromise your Rufio Account's security; and
(e) not to transfer your Rufio Account to anyone else without obtaining our prior authorisation.
2.4 We reserve the right to disable any Rufio Account, at any time, where it is suspected that unauthorised access has been obtained, or if in our reasonable opinion you have failed to comply with any of the provisions of these Terms.
2.5 Any personal information that you provide us in the course of registering your Rufio Account will be collected and used in accordance with the terms of Privacy Policy.
2.6 If you know or suspect that anyone other than you has obtained access to your Rufio Account, knows you must promptly notify us at woof@rufioapp.com.
2.7 By providing your information or creating a Rufio Account, you agree that we may contact you by email, telephone or text messages at any of the addresses or phone numbers, as applicable, provided by you connection with your Rufio Account, including for marketing purposes. You may opt-out of marketing emails via the provided unsubscribe link or otherwise opt-out by contacting us at any time.
3.1 The App provides a digital platform for pet owners to upload and track health and wellbeing information relevant to their pet and arrange for the provision of pet healthcare consultations with our licenced vet nurse practitioner, and any other services or we may offer from time to time (collectively, our "Services").
3.2 Rufio warrants that the Services shall be provided with reasonable care and skill, in accordance with these Terms.
3.3 After registering your Rufio Account, you will be prompted to create a profile for your pet ("Pet Profile"), where you can enter and upload health information relevant to your pet, including but not limited to medical conditions, medicines, supplements, allergies, vaccination records, vet records, insurance information, grooming records, identification, personality, breeder and rescue information, pet parents and owner information.
3.4 In addition to the Consultation Services (detailed below) the App includes a feature to notify you with recommendations or guidance based on your pet's health and behaviour tracking information that you upload to your Pet Profile.
3.5 You agree that all information that you provide and upload to the App via your Rufio Account and/or Pet Profile shall be in accordance with these Terms and our Policies.
3.6 The pet healthcare consultation service is offered via a live-chat function in the App to enable you to access information, guidance and advice from a vet nurse practitioner ("Consultation Services").
3.7 Our Consultation Service is provided for general pet health and non-urgent enquiries only and is strictly an advisory service. We are unable to provide any medical diagnosis, physical examinations, medication prescriptions or veterinary referrals for your pet. Where necessary, our practitioner may advise you to seek further medical advice, however it remains your sole responsibility to always seek independent veterinary advice. You should never disregard medical advice received from your pet's primary veterinarian or delay seeking medical advice as a result of any information or guidance obtained through the Consultation Service, or otherwise via the App.
3.8 Consultation Services can be accessed by submitting a request via the App's live-chat function, which is operational from 9am to 9pm UK time, 7 days a week. The Consultation Service is provided subject to availability and whilst we will endeavour to respond to all requests within 24 hours, we are unable to provide a guaranteed response time for all requests received.
3.9 The guidance and advice that you receive via the Consultation Service shall be based solely on the information that you provide to us. Accordingly, and in order to the deliver the Consultation Service effectively, you agree to provide us with all accurate information relevant to your request, together with any further details we may request during the Consultation Service, including written descriptions, images and videos where required.
4.1 Users agree to make use of the App and Services in accordance with applicable law, these Terms and our Policies. Users undertake not to use the App or the Services in any way that is harmful to the interests of other App user or the rights and interests of Rufio or its affiliates, or in any way that may damage or disable and the App and Services, or that otherwise prevents normal use.
4.2 The App allows Users to provide images and video content through relevant sections of the App. When providing image or video content, Users warrant that the images and/or videos provided:
(a) are the Users own images / videos;
(b) do not infringe the rights of any third parties (including but not limited to third party intellectual property rights or privacy rights); or
(c) do not contain any element that may be considered offensive or discriminatory of the following characteristics: race, religion, gender, sexual orientation, disability;
(d) do not contain any illegal, threatening, libellous, defamatory, obscene, pornographic or improper, or in any other way inappropriate element.
4.3 Users undertake not to use the App or the Services:
(a) in any way that breaches any local, national or international law or regulation;
(b) in any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect;
(c) for the purpose of harming or attempting to harm minors in any way;
(d) to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation;
(e) to transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of the App, the Services or Rufio's IT systems.
4.4 Users shall not directly or indirectly:
(a) copy, modify or create any derivative work of any portion of the App or the Services; or
(b) reverse engineer, decompile, decode, or disassemble or otherwise attempt to derive or gain improper access to any software component of the App, in whole or in part.
5.1 Rufio is the owner or licensee of all intellectual property rights in the App, the Services and all content or information made available via the App ("Content").
5.2 You may access, view and print off one copy, or download extracts, of any page(s) from the App for your own personal use and strictly in accordance with these Terms. You must not use any part of the content on our App for commercial purposes without obtaining a licence to do so from us or our licensors.
5.3 Rufio expressly reserves all intellectual property rights in our App, Content and Services and you must not:
We expressly reserve all rights in and to our trade name and App domain name.
7.1 The App or any Service may contain links to other independent websites and resources which are not provided by us. These are provided for your information only and are not under our control. We are not responsible for any third party website or resource and have not checked and approved their content.
7.2 Where you make use of any independent third party website, you acknowledge that You are doing so based on your own independent judgement about whether to use any such independent sites, including whether to buy any products or services offered by them.
8.1 From time to time we may automatically update the App and make changes to the Services to improve performance, enhance functionality, reflect changes to the operating system or address security issues. Alternatively, we may ask you to update the App for these reasons.
8.2 If you choose not to install such updates or if you opt out of automatic updates you may not be able to continue using the App and the Services.
9.1 Whilst we aim to ensure that the App is consistently available and accessible to all Users, we provide no guarantee that App will always be available, and we reserve the right to temporarily suspend access to the App and the Services without notice for the purposes of performing technical repairs, equipment maintenance, or to make improvement to the App or the Services.
9.2 We reserve the right to reserve the right to modify the App at any time in order to: (i) comply with legal obligations and safety requirements; (ii) improve the App's functionality; or (iii) to modify the Services made available to Users.
10.1 We reserve the right to suspend or terminate your Account and deny you access to the App and/or the Services at any time if, at our sole discretion, you are, or we have reasonable grounds to believe that you are in breach of any provision of these Terms or our Acceptable Use Policy.
10.2 You may delete your Rufio Account at any time through the setting function in the App, or by otherwise contacting us at woof@rufioapp.com.
10.3 Following termination of your Rufio Account, we reserve the right to keep a record of the information provided in relation to your Rufio Account and your use of the Services, in accordance with our Privacy.
11.1 The Content and information made available via the App is provided for general information purposes only. Whilst we endeavour to update all Content and information on the App regularly, we make no representations, warranties or guarantees, whether express or implied, that the Content is complete or up to date.
11.2 You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the information provided via the App and/or the Services.
11.3 Occasionally, the App may contain typographical errors, inaccuracies or omissions that may be associated with Service descriptions, prices, promotions, delivery times and availability. We reserve the right to correct these errors, inaccuracies, and omissions, as well as to change or update information if there are details in the App, which are inaccurate, at any time without prior notice.
12.1 To the fullest extent permissible by law, Rufio excludes and disclaims all warranties and representations whether express or implied in relation to the App or the Services. Rufio does not warrant or make any representations that the App will be uninterrupted or error-free, or that the App and any downloadable software, content or services made available in conjunction with or through the App are free of viruses or other harmful components. You are responsible for configuring your devices and information technology to access the App and you must use your own virus protection software.
12.2 The App and the Services is made available for personal, private use only and you must not use the App and/or the Services in connection with any commercial or business purpose.
12.3 Rufio shall have no liability for any loss of income or revenue, loss of business, loss of profits or anticipated savings.
12.4 Rufio will not be responsible for any failure to perform, or delay in performance, of any of our obligations under these Terms that is caused by you or any act or event beyond our reasonable control.
12.5 Nothing in these Terms shall exclude any liability which cannot legally be limited including liability for death or personal injury, negligence, fraud or fraudulent misrepresentation. Nothing in these Terms shall affect or limit your statutory rights.
We may transfer our rights and obligations under these Terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.
These Terms do not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any provision of these Terms.
Each clause contained in these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining clauses will remain in full force and effect.
Even if we delay in enforcing these Terms, we may still enforce at a later date. If we do not insist immediately that you do anything You are required to do under these Terms, or if we delay in taking steps against you in respect of Your breach of these Terms, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.
These Terms are governed by the laws of England and Wales and you can bring legal proceedings in connection with these Terms in the English courts. If you live in Scotland, you can bring legal proceedings in either the Scottish or the English courts. If you live in Northern Ireland, you can bring legal proceedings in either the Northern Irish or the English courts.
